ORDER REQUIRING NOTICE

Under 49 U.S.C. section 44907(d), I find that Ninoy Aquino International Airport, Manila, Philippines, does not maintain and administer effective security measures. This determination is based on Federal Aviation Administration assessments that reveal security measures used at the airport do not meet the standards established by the International Civil Aviation Organization.
Subsection (d)(1)(B) of 49 U.S.C. 44907 requires all air carriers and foreign air carriers providing service between the United States and Ninoy Aquino International Airport to provide notice of my determination to any passenger purchasing a ticket after the effective date of this order for transportation between the United States and Ninoy Aquino International Airport, with such notice to made by written material included on or with such ticket. Agents of such U.S. and foreign air carriers issuing U.S.-Manila tickets are also required to provide this notice. However, if an agent fails to do so, a carrier may carry the passenger if it provides the notice prior to boarding. I direct that the measures directed in this order be effective immediately.
The Department has decided that the following language, if provided to passengers in written material to be included on or with any U.S.-Manila ticket they may purchase, will meet the obligation to provide notice.
I am further directing that my determination be published in the Federal Register and that it be displayed prominently at all airports in the United States regularly being served by scheduled air carrier operations.
ACCORDINGLY:
1. The U.S. and foreign air carriers named on the attached service list providing service between the United States and NAIA, Manila, Philippines are notified of their obligation under 49 U.S.C. subsection 44907(d)(1)(B) to provide to any passenger purchasing a U.S.-Manila ticket after the effective date of this order, written notice of my determination that Ninoy Aquino International Airport, Manila, Philippines does not maintain and administer effective security measures;
2. This order shall be effective immediately; and
3. Copies of this order shall be served on the carriers and associations on the attached service list.

Under 49 U.S.C §44907, I have directed that a copy of this notice be published in the Federal Register, that my determination be displayed prominently in all U.S. airports regularly being served by scheduled air carrier operations, and that the news media be notified of my determination. In addition, as a result of this determination, all air carriers and foreign air carriers (and their agents) providing service between the United States and Ninoy Aquino International Airport must provide notice of my determination to any passenger purchasing a ticket for transportation between the United States and the Manila Airport, with such notice to be made by written material included on or with such ticket.
