ORDER REVOKING CERTIFICATE

By Order 93-11-39, issued November 26, 1993, the Department found Sky King, Inc., based in Sacramento, California, fit and issued it a certificate of public convenience and necessity authorizing the company to engage in interstate and overseas scheduled air transportation of persons, property, and mail. The effectiveness of that certificate was conditioned upon the Department's receipt of a copy of Sky King's Air Carrier Certificate and Operations Specifications issued by the Federal Aviation Administration (FAA) authorizing such services, evidence of liability insurance coverage meeting the requirements of section 205.5(b) of our rules, as well as a statement of any changes the company had undergone since the issuance of the show-cause order in this case.1

Section 204.7 of our rules provides, among other things, that the authority granted to an air carrier shall be terminated if it does not commence actual flying operations under that authority within one year of the date of the Department's determination of its fitness. In November 1994, Sky King requested that the Department allow it additional time to provide the material needed to have its authority made effective and, on December 5, 1994, the Department extended Sky King's revocation-for-dormancy date to June 1, 1995.

To date, the Department has not yet received the required information to make Sky King's authority effective. Moreover, we have been advised by the FAA that the carrier has suspended its attempts to obtain the required FAA authority until at least January 1996. Thus, it does not appear that Sky King has any plans in the near term to conduct the air transportation services authorized by its certificate.

Therefore, under these circumstances, and in accordance with section 204.7 of our rules, we will revoke Sky King's certificate for reasons of dormancy. This action is taken without prejudice to Sky King's filing a new application for a certificate at a later date.

ACCORDINGLY,

1. We revoke the certificate of public convenience and necessity issued to Sky King, Inc., by Order 93-11-39, authorizing it to engage in interstate and overseas scheduled air transportation of persons, property, and mail.

2. We will serve a copy of this order on the persons listed in Attachment A.
